WHAT IS A SHORT-TERM RENTAL?
A short-term rental is a dwelling unit rented out to occupants for fewer than 31 consecutive days.
AM I ALLOWED TO OPERATE A SHORT-TERM RENTAL?
Short-term rentals are prohibited in all residential zones. As outlined in City of Irvine Zoning Section 3-25-3.A, “no responsible party shall operate or allow the operation of a short-term rental in any residential zoning district within the City.”
AM I ALLOWED TO ADVERTISE A SHORT-TERM RENTAL?
It is a violation of the City of Irvine Zoning Ordinance to post, publish, circulate, or maintain any advertisement of a short-term rental. This includes listing the short-term rental on booking websites like Airbnb, Homeaway, and VRBO.
As noted in City of Irvine Zoning Section 3-25-3.B, “no responsible party shall post, publish, circulate, broadcast or maintain any advertisement of a short-term rental prohibited in any residential zoning district within the City.”
WHAT STEPS ARE BEING TAKEN TO ENFORCE SHORT-TERM RENTAL REQUIREMENTS?
The City of Irvine is working with Host Compliance, a leading technology company specializing in monitoring and enforcement solutions, to help identify short-term rentals operating illegally in local neighborhoods.

Your Homeowner’s Association, through your Covenants, Conditions, & Restrictions (CC&Rs), may also be a resource available to enforce short-term rentals.
WHAT ARE THE PENALTIES FOR OPERATING A SHORT-TERM RENTAL?
Escalating administrative fines between $100 and $500 may be issued each day a short-term rental violation continues. A Responsible Party who violates or fails to comply with short-term rental requirements may also be guilty of a misdemeanor.
I RECEIVED A COURTESY NOTICE LETTER. WHAT ARE MY NEXT STEPS?
If you received a Courtesy Notice, City records show that your property is operating as a short-term rental.
To avoid potential financial penalties, immediately cease and desist operation of all short-term rental activities and remove your property from online listings.
