UPDATE:  Irvine City Council unanimously votes to rescind City’s moratorium on wireless facilities

On April 28, 2009 the City Council voted to lift the wireless moratorium.  The City Council’s action will allow the City to consider new wireless facilities beginning in mid-June. New wireless facilities will be reviewed using City 
Ordinance No. 05-13.  

A second reading of the ordinance rescinding the moratorium is required by law. The City Council will consider the matter on May 12, 2009 at 4:00pm in the City Council Chambers at City Hall. If approved, the ordinance will become effective 30 days thereafter.

By way of background, on March 10, 2008, a court decision effectively invalidated Irvine’s Wireless Telecommunications Ordinance, which led to the adoption of a moratorium on the approval of wireless facilities installations.  Subsequently, in a separate action involving the County of San Diego, the Ninth Circuit Court of Appeals upheld the County’s wireless ordinance.  Because Irvine’s ordinance is similar, the City believed this decision had direct applicability to Irvine’s situation.  Consequently, the City pursued reinstatement of Irvine’s invalidated wireless communications ordinance.  The US District Court granted Irvine’s request on March 23, 2009.
